App Terms of Use

These terms apply to the InterSesh application and early-access product. By using the application, you agree to these terms. The public marketing website is covered separately by its Website Terms of Use.
About InterSesh
InterSesh is a behavioral-health technology platform for clinicians and clients. It supports between-session information gathering and clinical workflow, including organizing client-reported information, commitments, check-ins, journal entries, and material for session preparation.
Clinical judgment and professional responsibilities
InterSesh does not replace professional clinical judgment, provide treatment on a clinician’s behalf, or guarantee clinical outcomes. Summaries, signals, and other application outputs can be incomplete or inaccurate and must be reviewed in context before being used in a clinical decision.
Clinicians remain responsible for clinical decisions, assessment, treatment, informed consent, appropriate follow-up, and compliance with the laws and professional requirements applicable to their practice. Clinicians are also responsible for explaining how an authorized technology is used in their care and for determining its suitability. Using InterSesh does not itself establish a clinician-client relationship with InterSesh.
No emergency or crisis service
InterSesh is not an emergency or crisis service and is not continuously monitored. Do not rely on a check-in, journal entry, report, or other application activity to alert a clinician or obtain urgent help. If someone is in immediate danger or needs urgent assistance, contact the emergency or crisis services available in their location.
Early access and synthetic client information
Early-access use is limited to synthetic or fictional client information until InterSesh explicitly enables production data use. Do not enter identifiable client information, real clinical records, or content that could identify a client in profiles, free-text fields, uploads, or other features during this phase. Clinicians should use accurate details for their own professional accounts; test client accounts and client content must be fictional.
Production use with identifiable client information will be enabled as the applicable privacy, security, contractual, and jurisdictional safeguards are completed. Access to a feature, an invitation to early access, or an updated policy does not by itself authorize production use.
Accounts and credentials
Provide accurate information for your own account and keep it current, subject to the fictional test-client requirement above. Use only accounts and practice access you are authorized to use. Protect account credentials, do not share passwords, and sign out on shared devices. Tell us promptly if you suspect unauthorized account access. If you act for a practice or organization, you must have authority to do so.
Acceptable use
Use the application lawfully and within your authorized role. Do not attempt to access another user’s or practice’s information without permission, bypass access controls, impersonate another person, disrupt the service, introduce malicious code, or use information obtained through the application for an unauthorized purpose. Security testing requires prior authorization from InterSesh.
Availability during early access
The application is under development. Features and availability may change, and access may be interrupted, limited, or discontinued during early access. Test information may be reset or removed as testing evolves. Do not use early access as the sole record of care or rely on uninterrupted access. We do not promise a particular feature, release date, or level of availability.
Intellectual property and submitted information
The InterSesh software, branding, interface, and related materials belong to InterSesh or its applicable licensors. You may use the application for its intended, authorized purposes under these terms. Other use of protected materials requires permission unless permitted by applicable law.
You retain any rights you have in information you submit. You must have authority to provide it and allow it to be processed as needed to operate the features you use. Submitting information does not transfer ownership of it to InterSesh or remove the early-access synthetic-data restriction.
Privacy
The App Privacy Policy describes information involved in using the application, service-provider processing, and privacy requests. These terms and that policy do not replace any separate arrangements needed before production use with identifiable client information.
Service limitations and liability
To the extent permitted by applicable law, the early-access application is provided as available, without a guarantee that it will be uninterrupted, error-free, or suitable for every clinical workflow. Please verify information and outputs before relying on them.
To the extent permitted by applicable law, InterSesh is not responsible for indirect or consequential losses, such as lost profits or lost business opportunities, arising from use or unavailability of the application. This does not exclude responsibility for reasonably foreseeable direct losses caused by a failure to meet obligations that apply to InterSesh.
Nothing in these terms excludes or limits liability for fraud, wilful misconduct, gross negligence, or any liability that cannot lawfully be limited. These terms do not remove rights, warranties, or remedies that applicable law does not allow users to waive.
Termination and account deletion
You may stop using the application and request account closure or deletion by contacting us. InterSesh may suspend or end access where reasonably necessary to address misuse, protect the service or other users, comply with law, or conclude early-access testing. Where practicable and appropriate, we will explain the reason.
Account closure and information deletion are handled as described in the App Privacy Policy, including identity checks and any applicable retention obligations. Clinicians remain responsible for their own lawful recordkeeping and continuity-of-care arrangements.
Changes to these terms
We may update these terms as the application develops. The date above shows the latest revision. We will provide notice of material changes or seek agreement where required by applicable law. If you do not agree to revised terms, you may stop using the application and request account closure.
